These Terms of Service (“Terms”) govern your access to and use of the Africon mobile application, website, and related services (collectively, the “Platform”). By creating an account, entering a competition, uploading content, or using Africon in any capacity, you agree to be legally bound by these Terms.

1. The Africon App

  • •Africon is a structured digital competition ecosystem designed to identify, elevate, and professionally recognize creative talent across Africa and the African diaspora.
  • •Africon operates as:
  • •A competition infrastructure provider
  • •A sponsor-backed prize administration system
  • •A public performance credential platform (Leaderboard)
  • •Africon is not a casual social media platform. It is a structured recognition and prize distribution system built for measurable creative achievement.

2. Competition Participation & Prize Governance

  • 2.1 Sponsored Competitions
  • •Competitions on Africon are funded through commercial sponsorship agreements between Africon and verified Sponsors.
  • •Africon administers:
  • •Competition design
  • •Prize structuring
  • •Winner verification
  • •Prize disbursement
  • •Sponsors fund competitions. Africon governs the structure and execution.
  • 2.2 Advertised Prize Amount
  • •The prize amount displayed for any competition represents the exact amount that the declared winner will receive.
  • •Africon does not deduct:
  • •Platform commissions
  • •Administrative fees
  • •Processing charges
  • •from the advertised prize amount.
  • •The amount displayed equals the amount paid to the winner.
  • 2.3 Sponsorship Fees & Financial Confidentiality
  • •Sponsors may pay Africon a total sponsorship fee that may or may not exceeds the publicly advertised prize amount.
  • •The total sponsorship fee paid by a Sponsor:
  • •Is confidential commercial information
  • •Is proprietary to Africon
  • •Is not disclosed to creators, users, media, or the public
  • •Creators acknowledge and agree that:
  • •The publicly displayed prize amount represents the official competition reward.
  • •The prize amount may not reflect the total commercial sponsorship value.
  • •Africon retains sole discretion in determining how sponsorship funds are structured and allocated within the Platform ecosystem.
  • •Africon reserves the exclusive right to:
  • •Determine what portion of sponsorship revenue constitutes prize pools
  • •Structure multi-tier prize allocations
  • •Adjust prize distributions
  • •Retain portions of sponsorship revenue for operational, promotional, or ecosystem sustainability purposes
  • •Africon is under no obligation to disclose internal sponsorship agreements or commercial structures.
  • 2.4 Sponsor Confidentiality Obligations
  • •Sponsors are strictly prohibited from disclosing:
  • •The total sponsorship fee paid to Africon
  • •Any breakdown of sponsorship financial terms
  • •Any internal commercial agreement with Africon
  • •to creators, users, media outlets, press representatives, bloggers, influencers, or on any social media platform without prior written approval from Africon.
  • •Unauthorized disclosure may result in:
  • •Immediate termination of sponsorship agreements
  • •Removal of sponsor branding from the Platform
  • •Legal enforcement remedies
  • 2.5 48-Hour Payout Guarantee & Currency Conversion
  • •Once:
  • •A winner is officially declared; and
  • •Prize funds are credited to the internal Africon Wallet,
  • •the user may initiate a withdrawal request at any time.
  • •Africon guarantees that approved withdrawals will be disbursed to the user’s verified bank account within 48 hours of a valid withdrawal request.
  • •Internal Wallet Currency
  • •All prize funds credited to the Africon Wallet are denominated and stored in United States Dollars (USD).
  • •The USD value credited to the wallet represents the official prize amount awarded.
  • •Currency Conversion & Local Disbursement
  • •Where a user’s verified bank account operates in a currency other than USD:
  • •Africon will convert the USD wallet balance into the user’s local currency.
  • •Conversion will be calculated using the prevailing exchange rate at the time the withdrawal request is approved.
  • •The exchange rate applied may reflect market rates, banking partner rates, or payment processor rates at the time of execution.
  • •The final amount received may vary due to:
  • •Foreign exchange fluctuations
  • •Banking spread margins
  • •Cross-border transaction adjustments
  • •By initiating withdrawal, the user agrees to accept the converted amount based on the exchange rate applied at approval.
  • •Conditions of the 48-Hour Guarantee
  • •The 48-hour payout guarantee applies subject to:
  • •Completed identity verification
  • •Accurate banking information
  • •No ongoing fraud or compliance investigation
  • •No violation of these Terms
  • •Africon shall not be liable for foreign exchange losses or delays caused by third-party financial institutions.

3. Leaderboard & Verifiable Credentials

  • 3.1 Permanent Performance Record
  • •All official competition results are recorded on the Africon Leaderboard.
  • •Leaderboard entries include:
  • •Username
  • •Competition category
  • •Ranking position
  • •Date achieved
  • •These entries serve as permanent Verifiable Digital Credentials.
  • 3.2 Fair Play & Anti-Manipulation Policy
  • •The following are strictly prohibited:
  • •Bot-generated engagement
  • •Artificial vote inflation
  • •Fraudulent ranking systems
  • •Exploitation of technical vulnerabilities
  • •Coordinated manipulation
  • •Africon reserves the right to disqualify participants, revoke prizes, suspend accounts, or pursue legal remedies where necessary.

4. User-Generated Content (UGC)

  • 4.1 Ownership
  • •Creators retain 100% ownership of their original video content.
  • •Africon does not claim copyright ownership.
  • 4.2 Limited Competition License
  • •By entering a competition, you grant Africon and the relevant Sponsor a:
  • •Non-exclusive
  • •Royalty-free
  • •Limited promotional license
  • •to feature your submission solely in connection with the specific competition entered.

5. Content Standards & Prohibited Material

  • •Africon is a professional, sponsor-backed ecosystem. All content must remain brand-safe and compliant with these standards.
  • 5.1 Prohibited Content
  • •The following content is strictly prohibited:
  • •Nudity or sexually explicit material
  • •Pornographic or erotic content
  • •Sexually suggestive performances intended for arousal
  • •Obscene or indecent content
  • •Content involving minors in inappropriate contexts
  • •Hate speech or discriminatory material
  • •Graphic violence or disturbing content
  • •Promotion of illegal activities
  • •Africon maintains zero tolerance for explicit sexual content.
  • 5.2 Moderation & Enforcement
  • •If prohibited content is uploaded:
  • •Africon may immediately remove or disable the content.
  • •The user may receive a warning notice.
  • •If violations are repeated, severe, or disruptive to the ecosystem, Africon reserves the right to:
  • •Restrict competition participation
  • •Freeze wallet access pending review
  • •Suspend account functionality
  • •Permanently terminate the account
  • •Where content escalates or threatens platform integrity, Africon may impose immediate restrictions without prior notice.
  • 5.3 Discretionary Authority
  • •Africon retains sole discretion to determine whether content violates these standards and may remove content at any time to protect:
  • •Sponsor relationships
  • •Platform credibility
  • •Community safety

6. Platform Conduct & Account Governance

  • •Users agree to:
  • •Provide accurate information
  • •Respect other users
  • •Comply with all applicable laws
  • •Maintain professional conduct
  • •Africon reserves the right to suspend or terminate accounts that violate these Terms.

7. Independent Professional Relationships

  • •Africon is not responsible for off-platform contracts, brand deals, or independent collaborations formed outside the Platform.

8. Limitation of Liability

  • •Africon shall not be liable for:
  • •Indirect or consequential damages
  • •Currency fluctuation losses
  • •External contractual disputes
  • •Loss of business opportunity
  • •Liability is limited to the prize amount associated with the competition in dispute.

9. Governing Law

  • •These Terms shall be governed by the laws of the jurisdiction in which Africon is incorporated and operates, subject to applicable regional regulations.

11. App Store & Platform Compliance

  • •Africon operates in compliance with applicable mobile application marketplace rules, including but not limited to the Apple App Store Review Guidelines and Google Play Developer Program Policies.
  • •Users acknowledge and agree to the following:
  • 11.1 No Gambling or Chance-Based Wagering
  • •Africon competitions are skill-based.
  • •Winners are determined through structured performance criteria, ranking systems, or transparent evaluation mechanisms.
  • •Africon does not operate gambling, betting, lottery, or games of chance.
  • •No user is required to pay an entry fee to receive a chance to win a prize unless clearly stated and compliant with applicable law.
  • •Africon reserves the right to modify competition mechanics to ensure ongoing regulatory compliance.
  • 11.2 In-App Payments & Wallet Structure
  • •Africon’s internal wallet:
  • •Is used solely for prize disbursement.
  • •Is not a stored-value bank account.
  • •Is not a cryptocurrency system.
  • •Cannot be used for peer-to-peer transfers.
  • •Cannot be used to purchase unrelated digital goods outside the Platform.
  • •Wallet balances represent prize earnings only and may not be resold, traded, or transferred.
  • •Africon does not guarantee that wallet balances are interest-bearing.
  • 11.3 Third-Party Payment Processing
  • •All withdrawals are processed through authorized banking or payment partners.
  • •Africon does not:
  • •Store full payment card details.
  • •Process financial transactions outside approved payment systems.
  • •Facilitate prohibited financial services.
  • •Users agree that third-party payment providers may apply additional compliance procedures as required by law.
  • 11.4 Content Moderation Compliance
  • •Africon maintains active content moderation systems to comply with marketplace policies, including:
  • •Prohibition of sexual content
  • •Prohibition of harmful or violent content
  • •Protection of minors
  • •Anti-harassment enforcement
  • •Intellectual property compliance
  • •Africon reserves the right to remove any content that violates platform policies or mobile marketplace requirements.
  • 11.5 Age Restrictions
  • •Africon is intended for users aged 18 years or older.
  • •By creating an account, users represent and warrant that they meet the minimum age requirement in their jurisdiction.
  • •Africon reserves the right to suspend accounts suspected of being operated by minors.
  • 11.6 Platform Removal Rights
  • •Africon reserves the right to:
  • •Modify features
  • •Suspend certain functionalities
  • •Restrict geographic access
  • •Update competition mechanics
  • •where necessary to maintain compliance with:
  • •App Store policies
  • •Google Play policies
  • •Payment regulations
  • •Local jurisdictional requirements
  • 11.7 No Marketplace Endorsement
  • •Use of the Africon Platform through any app marketplace does not imply endorsement by:
  • •Apple Inc.
  • •Google LLC.
  • •Any affiliated marketplace operator.
  • •Users agree that such marketplaces bear no responsibility for Africon competitions, payouts, or content.
  • 11.8 Updates & Regulatory Adjustments
  • •Africon may update its policies, wallet structures, payout systems, or competition mechanics to maintain compliance with evolving marketplace and regulatory requirements.
  • •Continued use of the Platform constitutes acceptance of such updates.
